Are these flower stock photos exclusive to my project?

The standard licence is non-exclusive. What that means in practice, how likely a clash really is, and how to buy exclusivity.

The standard licence is non-exclusive. Another buyer may licence the same photograph, for the same kind of use, at the same time. If that is unacceptable for your project, read to the end.

What non-exclusive means in practice

It does not mean the image is everywhere. It means we do not promise it is not.

The realistic risk depends entirely on the picture. A tightly cropped macro of an unusual cultivar is unlikely to turn up on a competitor's packaging. A clean, well-lit, white-background rose on a common variety is exactly the kind of frame that several people will buy, because it is exactly the kind of frame several people need.

If your project is the front of a box, assume the second case and act accordingly.

Reducing the risk without paying for exclusivity

Three things help, and all of them are free.

Edit distinctively. A photograph that has been cropped hard, recoloured to your brand palette and composited into your own layout stops being recognisable as a stock frame. Two buyers of the same file can produce work nobody would connect.

Prefer the specific over the generic. The unusual cultivar, the odd angle, the imperfect stem. These are less bought and more memorable, which is two arguments for the same choice.

Check the collection. Images in the premium collection are the ones most likely to be doing heavy commercial work for someone, precisely because they are the strongest frames.

Buying exclusivity

If the picture must not appear anywhere else, we sell buy-outs. Write to us with the asset id and a description of the use, and we will quote. A buy-out withdraws the image from the catalogue and transfers an exclusive licence for the term you need; it costs substantially more than one hundred dollars, for the obvious reason that we stop selling the file.

We will tell you honestly whether an image has already been licensed widely. Buying exclusivity on a photograph that is already on somebody's packaging is not something we will take your money for.

What exclusivity is not

An exclusive licence is still a licence. It does not transfer copyright, it does not let you register the image as your own work, and it does not let you resell the file. If you need to own the photograph outright, that is a different conversation and a different contract; ask, and we will tell you whether the frame in question is available on those terms.
